Personal Information
 
When you choose to sign up for Membership or access rights to restricted areas or forums you may be asked to provide your name, email address, address, city, state, country, zip code, phone number, or your personal/ business website links. For more information see the TAS Members Agreement & TAS Forum Registration Agreement.
 
What do we do with this information? We use the name and email address to e-mail you member information or forum information and to provide you with notifications and announcements when necessary. We use this information to verify membership and access rights to member restricted areas.

Information may be given to or allowed to be viewed by other members for the purpose of contacting members. We use some of the optional information to help us provide statistics to guide TAS in developing content of interest to visitors (i.e. who is visiting us, what pages) so that we can better meet peoples interest.
 
What do we not do with the information? We don't sell your identity to any third parties. We don't sell your information that you place on our sites to any third parties.

 

Cookies and IP Addresses
 
There is additional information that can be gathered by an operating web site. One is the IP address (random numbers assigned to individual computers) of the machine you use to reach these sites. This information is used to help diagnose problems with the TAS sites. We can potentially use your IP address to help diagnose problems with our servers and to administer our Web sites. Your IP address may also be used to block your access to areas of these sites if we determine that you are abusing the sites resources.
 
Another way to gather information is to use a cookie (small text file transferred from our Web site to your hard drive). TAS uses cookies to determine if you are logged in and also to save your login information to speed up your access to the sites. Cookies do not damage files or allow anyone to access your personally identifiable information. You may remove them by following your browsers direction. They also provide information to us about site usage to help us improve and update our sites. We may create aggregate (not individual) site usage statistics and demographic information but this information will not include any personally identifiable information.
 
Privacy.

You acknowledge that, if public posting areas are provided, that all postings in forums are public and not private communications, and that therefore others may read your communications without your knowledge. Always use caution when giving out any personally identifying information about yourself or your family in any public area. TAS does not control or endorse the content, messages or information found in any public posting area beyond the statements in the registration, members, legal or usage agreements and, therefore, TAS specifically disclaims any liability with regard to these areas and any actions resulting from your participation. Generally, any communication which you post to any public area (whether in chat rooms, discussion groups, message boards or otherwise) is considered to be non-confidential. These links are provided solely as a convenience to you and not as an endorsement by TAS of the contents on such third-party Web sites. If you decide to access linked third-party Web sites, you do so at your own risk. Indemnity

You agree to defend, indemnify, and hold harmless The Angelfish Society, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the materials or information contained on this site, or your breach of the terms of this Agreement.

General

The Angelfish Society is incorporated in the county of Cattarugus in New York State. All legal issues, disputes and matters whatsoever arising from or related to the use of the TAS Web Site, including any applicable public forum area, shall be construed in accordance with and determined by the laws of New York State.

By using these Web Sites, you agree that the exclusive forum for the bringing of any claims or causes of action arising out of or relating to your use of these Web Sites or forum areas is the United States District Court for New York State, or if such court lacks subject matter jurisdiction, the Superior Court of the State of New York for Cattarugus County. It is agreed that New York law will govern remedies for breach or any other claims relating to this agreement. You hereby accept and submit to the jurisdiction [personal and subject matter] of such court in any such proceeding or action, and irrevocably waive, to the fullest extent permitted by law, any objection which you may now or hereafter have to the laying of the venue for subject matter or personal jurisdiction of any such action or proceeding brought in such a court and any claim that any such action or proceeding brought in such a court has been brought in an inconvenient forum.

If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in a particular "Legal Notice" on particular web pages, this Agreement constitutes the entire Agreement between you and The Angelfish Society with respect to the use of Web Sites and forums.

Any changes to this Agreement must be made by a resolution of the Board of Directors of The Angelfish Society in accordance with its Bylaws and the laws of New York State under which it operates.

The Angelfish Society reserves the right to alter our Privacy Policy, Legal Notices & Agreements as business needs require. Any changes will be posted to our web site in a timely manner. This statement and the policies outlined here are not intended to and do not give you any contractual or other legal rights.
